Content Marketing Tools for Eldercare Professionals: Blogging, Newsletters, Social Media and Content-Rich Websites

By signing the contract, you are agreeing the applicable terms expressed below. If/when the terms are updated, you will be notified via email at your address on file with us.

Terms

Client refers to the individual or company utilizing the services. Service Provider refers to Elder Pages Online, LLC.

Website

Website configuration: The website is developed as a template in a WordPress Multisite platform hosted on a WP-Engine server with Cloudflare for domain management. The site will be branded with Client’s name, logo and colors. Client understands that the website is based on a template structure with several design options. Client may supply Its own graphics for the website. Beyond the branding and placement of unique graphics, other layout revisions are possible, but may be subject to extra programming charges.

Web addresses: Client will license and maintain ownership of Its commercial domain name and is responsible for managing any email addresses connected to it. Client can change the DNS pointers to send Web traffic to Service Provider’s IP address, or Client can give Service Provider login access at the registered host and Service Provider can change the settings. It will be Client’s responsibility to renew the registration of the domain name each year and to manage Its own email infrastructure.

Graphics: Service Provider will furnish all graphics currently appearing in the template of the website and warrants that Service Provider has the right to publish these graphics. Client will furnish any company-specific graphics, in web-ready format (e.g. logo, photos), and warrants that Client has secured the rights to publish those graphics.

Individualized content: Client is responsible for entering all of the individualized content (e.g., About Us, Testimonials). Client may edit pages and add Its own text, video and graphics on any page except the home page, which requires Service Provider participation to change. Client is responsible for responding to interactive input from viewers (e.g., Contact Us, Request More Information, Schedule a Consultation, and the feedback form). Client warrants that Client has the right to publish individualized content entered on the website.

Search engine optimization (SEO): All standard “white hat” methods have been implemented to help Client appear organically in a Google search. Service Provider cannot guarantee page ranking, however, nor placement of any given page on a search result. For custom search engine optimization with local keyword and competitive analysis, Google Ad Word purchases, etc. Service Provider can recommend a reputable SEO expert.

Form notification system: Client will receive both a text and email notification when a website viewer completes any of the contact forms included on the website. Client can also access the database of responses by logging in to the administrative end of the website. Responses will be kept for 365 days.

Additions to the website template: Simple changes to the home page may be made (for instance, changes in typography, insertion of local video and unique graphics). There is no additional cost for Client to request the addition of 5-8 pages as long as Client is responsible for entering the content and graphics. Pages with forms may be added if they are essentially a duplication of existing form pages with no new fields needed (e.g., “Request a Checklist” can be created by duplicating the fields from “Request more information.”)

Licensed Content

Elder Pages Online, LLC content: Service Provider will furnish original text for licensed content. Service Provider warrants that It has the right to publish this text. Client may add to or revise text and graphics as desired. Client may use the content within the context of marketing efforts only for services delivered in the territory designated in the exclusive.

Exclusive: Client will receive exclusive rights to the services licensed for their market, defined in their contract. To protect Client’s exclusive, this territory will be listed prominently in the header of the website and print materials. Large cities will also be mentioned on the website for greater optimization in a local search. Service Provider will not knowingly license the proposed resources to any competing entity marketing within this territory. Client may serve customers anywhere, but agrees to not actively market Its services using these resources outside the licensed territory. (“Active marketing” includes activities such as meeting with referrers, doing presentations, and distributing handouts, as well as announcing particular cities or counties on the website.) If Client expands to a new service area and/or opens a satellite office, and wants to use these resources for marketing those services, the territory can be expanded under a separate contract to include this new area, provided there is no Elder Pages Online, LLC customer with an existing exclusive. Non-payment of fees will result in loss of Client’s exclusive.

Educational URL: To drive traffic to Client’s resources, Service Provider will furnish an educational URL that sends viewers directly to the licensed content page on Client’s website. This URL will display prominently on any handouts and can be used to drive traffic to the blog and encourage other websites (e.g., of referrers or strategic partners) to add links on their website to Client’s educational resources. The cost of the URL is included in the package.

Publishing rights: Client may edit text and graphic content. For marketing purposes, short excerpts of 2-5 sentences with thumbnail images may be included in promotional materials encouraging further engagement with the content (e.g., Facebook posts). Other than these short excerpts, content may NOT be published as entire posts in other media (e.g., as newspaper articles, or as handouts copy/pasted onto Client’s letterhead). Nor may content be independently embedded as entire articles in other online venues (e.g., online newspaper blogs, guest blog posts) without the prior consent of Service Provider. Options to publish in local newspapers (e.g., Senior News) may be arranged with Service Provider by separate contract.

Graphics: Service Provider will furnish all graphics appearing with content and warrants that Service Provider has the right to publish these graphics. Client may not use graphics for other purposes as the stock photography license is for content resources only. Client will furnish any company-specific graphics, in web-ready format (e.g. logo, header, staff photo), and warrants that Client has secured the rights to publish those graphics.

Video: Service Provider will furnish professionally produced video files. Client is licensing the right to display the online video files on Its e-library only. The video files are hosted on a special video server at Vimeo.com. Video files are not editable. Client may host Its own videos elsewhere (e.g., YouTube, Its own private Vimeo account) and insert into content.

Individualized content: Client is welcome to edit Service Provider’s online content and/or to publish its own personal content. (For blog posts, it is recommended that Client create Featured Images for that are 700 pixels wide x 400 pixels tall, at 72 dpi). Handout PDFs may not be edited. Client warrants that Client has the right to publish local content entered on the website.

Service provider content updates: As appropriate, given recent research findings, Service Provider will update the educational content.

Standalone Content

Standalone content refers to licensed content by Service Provider, hosted separate from Client’s commercial website. It is published within the Service Provider’s WordPress platform which allows for online display as well as editing in the cloud. Appropriate links will point back to Client’s commercial website. Client will receive an educational web address for the standalone webpages that aligns with the name of Its newsletter/blog.

Presentations

Contingent upon licensing of periodical content (e.g. family Caregiver Newsletter or Aging Well Blog). The presentation is available only to Clients who license the corresponding periodical. If Client were to no longer license the corresponding periodical, then the right to use the presentation, and ancillary materials (handouts, etc.) would be terminated.

Exclusive: Client will receive a territorial exclusive for the same area as Its periodical. For as long as Client continues to license the periodical, Content Provider will not knowingly license presentation resources to any competing entity marketing within this territory.

Publishing Rights: Client may edit text and graphic content in the PowerPoint presentation, and in any other documents delivered in Word format. Text and graphics in the branded .pdf handouts cannot be edited.

Graphics: Content Provider will furnish all graphics appearing with the PowerPoint and ancillary materials, and warrants that Content Provider has the right to publish these graphics. Client may not use graphics from the PowerPoint and ancillary materials for other purposes as the stock photography license is only for the resources being licensed by Client. Client will furnish any company-specific graphics, in web-ready format (e.g. logo, staff photo), and warrants that Client has secured the rights to publish those graphics.

Printable PDFs

This service provides Client with PDFs of licensed content, so Client can print and distribute paper versions. Technological creation of PDF files is provided by DocRaptor PDF conversion service. There are no extra charges to Client, nor specific terms and conditions for DocRaptor’s service.

Printable content will include Client’s name, logo, and colors with Client’s territory and educational URL. Client has the option to furnish its own header if preferred.

Delivery of physical printables is not included in this contract. It is Client’s responsibility to print the PDF files. The PDF files are optimized for color printing at FedEx Office. Client may be able to print the hard copy resources in-house, depending on the quality and capacity of Client’s equipment (e.g. a duplex printer is recommended so the content may be printed on front and back of a single piece of paper.) Client is encouraged to use heavier weight paper (e.g., 28 lb) with a brightness index of 100. This makes for a crisp, more professional look and reduces the chance of the ink bleeding through from front to back. A toner-based printer delivers better results than an ink jet.

Client agrees to be responsible for the proofing of all files for typos and color synchronization prior to print publication. While all efforts are made to ensure there are no errors or color discrepancies, it is Client’s responsibility to approve proofs before a publication run.

Older content: Content may have been published prior to Client’s start date with the service. Client will have the ability to access the PDFs of past handouts and print as many hard copies as desired. There is a slight possibility that a previous licensee of the content may continue to be using their version of the handouts in the same territory. This is not within their publishing rights. If Client discovers one in circulation, please send a photo to Service Provider and all efforts will be expended to have the previous licensee cease and desist. This has never yet been a problem as all Clients have so far been very respectful of publishing rights and limitations.

Editing and changes: Print materials cannot be edited. Edits may be requested, however, if they pertain to undiscovered typos or information that has become outdated. There is no charge for edits of this nature. Client may request a change in the right side bar text and graphics, and can at any time send a replacement header for the graphic along the top. Family Caregiver Newsletter printables are created with stock photographs of a wide diversity of family caregivers in the right side bar, along with a quote pertinent to the lead article. If Client prefers to have a static image with a static caption below, this can be arranged at no extra charge.

PDF index page: The index page is intended for internal (staff) usage only and will be hidden from search engines and website visitors (no links to it visible in the public view of the company website). Client is encouraged to share the index page URL with staff.

Interactive PDF files (Marketing Packages): These documents will be branded to include Client’s company name, phone number and URL. Also the state-specific name for the POLST, if there is one. Client will have exclusive use of these documents for as long as Client continues to license them.

Family Caregiver Guide brochure: The brochure is based on a template layout. The text content will be customized to fit Client’s unique service offerings. The brochure will be branded with Client’s name, logo, colors, contact information and photo. Local graphics supplied by Client can replace those used in the template. Client will be responsible for giving feedback on proposed content.

Client will receive up to three drafts of the contract: An initial draft for feedback. A second draft based on Client-requested changes. A third draft that incorporates subsequent changes and the suggestions of the copy editor (punctuation, grammar, etc). Further revisions will be charged at the rate of $100/hour with a 1-hour minimum.

Turnaround time: Typically a print master file can be created with 4 weeks turnaround. Client responsiveness is a key determinant in the speed with which the documents are ready. Webmaster is not responsible for tardiness on Client’s part.

Custom Work

For Clients who wish to have more assistance, or more custom work beyond the standard licenses, we offer the following additional services (half hour minimum):

  • Virtual assistance: Entering text and graphics provided by client onto standard interior pages on a website page (e.g. About Us, blog, newsletter) or uploading of subscribers to Constant Contact. Light graphics work such as resizing a logo or photo. (Cost: $50/hour)
  • Light programming and template code changes: For example, home page changes or rearrangements. Changes in color style sheet, or setting of new domain name, hooking up Calendly to Client’s digital calendar. (Cost: $140/hour)
  • Custom graphics and more significant redesign of pages: For example, custom home page design, animations, photoshopping people into or out of a photo, adding/changing a background to a photo. (Cost: $200/hour)
  • Custom writing: Based on interviews with Client, custom text for Our Services pages can be composed and edited for strategic highlights utilizing popular search engine terms. Service Provider will interview Client to determine which services should be highlighted and will compose custom Our Services text for recommended pages. This contract includes two revisions. (Cost: $100/hour.)

Email Marketing

Creation and sending of the email announcement: Each month Service Provider will enter the text and schedule the sending of the email announcement containing licensed content to the designated subscriber list within Constant Contact.

Constant Contact account: Unless Client already has a Constant Contact account, Service Provider will open and prepare a trial email marketing account. Service Provider will create the basic infrastructure of email template and email lists. Client will be responsible for the payment of the Constant Contact account, the uploading of subscribers, general list management (e.g., pruning out dead email addresses), and compliance with anti-spam laws. Service Provider is not responsible for email campaigns that do not go out because of late payments in the Client’s account.

Constant Contact login: If Client already has a Constant Contact account, Client will give Service Provider a manager account for login access.

Subscriber list: Client may have as many lists as desired on Constant Contact, but everyone who is intended to receive an email announcement must be included in a list titled something related to the content. (e.g. Aging Well Blog, Family Caregiver Newsletter…) They can also be in other lists, but this is the only list Service Provider will schedule to receive the email announcements.

Compliance with anti-spam laws: In order to be compliant with anti-spam laws, Constant Contact’s service is limited to sending emails to “permission-based” lists (e.g., individuals who have requested to hear from Client, or with whom Client already has an email relationship). It is a violation of Constant Contact’s anti-spam policy to send emails to a purchased list or to a group distribution email address (e.g., members@chamberofcommerce.com).

Independent use of Constant Contact account: Client owns Its Constant Contact account and may initiate Its own marketing campaigns utilizing Constant Contact templates, delivery functions, list management, and tracking and reporting features. In addition, Client is welcome to contract with Constant Contact for other services: Surveys, Event promotion, etc. Service Provider is not responsible for training Client outside the context of the licensed service. Constant Contact has a robust support system to help with its services including phone, email and chat-based coaching options; a learning center with tutorials; and recorded and live webinars.

Social Media

Contingent upon licensing Elder Pages Online, LLC content: The social media posts are an add-on service to licensed content.

Professional profile/page: This contract and pricing assumes Client has already set up a page or professional profile, depending on the platform. Service Provider is not responsible for setting up this page. Social media services are for the posting of content only.

Login access: If needed, client will give Service Provider Client’s username and password and keep Service Provider updated if the login changes. Client is encouraged to NOT activate dual authentication as this will prevent Service Provider from being able to enter content. Client may need to add an auxiliary email address provided by Service Provider so Service Provider can have access.

Graphics: Service Provider will furnish all graphics appearing with the social media posts and warrants that Service Provider has the right to publish these graphics. Client may substitute other graphics as desired. Client may not use graphics for other purposes in other media.

Individualized content: Client is welcome to edit Service Provider’s social media posts and/or to publish Its own posts.

Google Services

Google Business Profile (GBP): The GBP is the centerpiece for all Google Services as Google uses this to confirm that all information about a business is genuinely from the owner and is entirely accurate. Client will need a Google Account and will be assigned the role of Owner of the page. Service Provider is simply the Manager. (Client may remove Service Provider’s access at any time.) Google does not charge a fee for a Google Business Profile, but they have strict requirements for accuracy and require a unique page for each office (brick and mortar) location of the business.

  • Client’s responsibility: To respond promptly—within 5 business days—to Service Provider requests and to answer accurately. In particular, Client must be timely in its notification to Service Provider when the verification post card arrives as this is a time-sensitive document, or with the video, if Google requests video verification. Client will receive a basic orientation about editing Its GBP. After the first 4 weeks of going live, Client will be responsible for the updating and editing of all local information (e.g., holiday hours, moving to a new location).
  • Service Provider’s responsibility: To create or update Client’s Google Business Profile and provide initial orientation and overview/training regarding the updating of Client’s GBP. If in the course of establishing a GBP, it turns out Client has numerous GBP listings for the same business (perhaps initiated long ago, or by a long-gone employee) or has over the years posted several different addresses or phone numbers on the Internet for the same business, extensive clean-up may be required as Google will only allow one listing per business per location. Client will be given ample notice, referral to a certified Google Partner, and a cost estimate for the clean-up of past listings that fall outside the scope of this contract. (This very rarely happens, but it is a possibility.)

Google reviews service: Service Provider will activate a plugin on Client’s website for the purpose of bringing in Google Reviews and displaying them on select pages. Reviews will be filtered to only display those with 4-5 star ratings.

  • Service Provider is responsible for the licensing, and updating of the plugin, and establishing the connection to Client’s GBP and the Google Reviews entered there.
  • Service Provider will provide an orientation on gathering reviews (from existing customers, former customers, and from referrers) and on handling negative reviews.
  • Client will receive a custom URL to send with requests for a review.

Blogging on Google Business Profile: As part of this project, Service Provider will push updates of the blog posts out to Client’s Google Business Profile. Service Provider is responsible for maintaining the infrastructure for posting, and establishing the GBP connection.

  • Blog content: Updates will be derived from the content that Client licenses from Service Provider.
  • Contingent upon Client’s licensing of Service Provider’s content: The specifics of publishing rights and responsibilities are covered under a “Licensed Content” above. If Client should elect to no longer license the content, then posting to the GBP would cease and this service will be terminated.

Exclusive territory for blog posting: Client is licensing content from Service Provider and receives a territorial exclusive for that service. The GBP contracted to receive the content posts will correspond to the exclusive territory for Client’s blog. Client agrees It will not use these Google Services to actively market Its services outside this territory. If Client expands to a new service area (e.g., opens a new GBP), and wants to use the content for marketing in that new area, Client’s territory for the content will need to be expanded under a separate contract to include this new area, provided there is no Elder Pages Online, LLC customer with an existing exclusive. A contract addendum will also need to be arranged to cover the expense of setting up the services and license to publish to an additional GBP.
